Under the Individuals with Disabilities Education Act (IDEA), parents of children with disabilities have a right to access “all records” about their children. In G.C. v. Capital School District, a parent has argued that this right allows parents to access emails that school-district staff send about their children. A federal district court agreed with the parent, but the school district appealed the district court’s decision to the U.S. Court of Appeals for the Third Circuit.
Berney & Sang recently submitted an amicus brief in support of the parent in the the Third Circuit. Berney & Sang co-counseled the brief with the Public Interest Law Center. Here is a copy of the brief: G.C. Amicus Brief.
G.C. is still pending before the Third Circuit.
